THE owner, Arcome / SM, and master, Mr A Fautral, of the French-registered trawler Cap Frehel (MX681131), pleaded guilty to technical conservation offences at Plymouth Magistrates' Court on 13 March.

Their vessel was boarded by a marine enforcement officer on the UK Border Agency cutter Vigilant in the Western English Channel (ICES Area VIIe) on 11 March and detained to Plymouth for further investigations. The average mesh size of the extension piece section of the fishing net was found to be less than the required 100 mm needed for the catch retained on board the vessel.

The owner was fined 3,300, 5,000 value of catch plus 1,582.65 in costs. The master was fined 625. Both also had to pay a 15 victim surcharge.

The Marine Management Organisation recognises that the vast majority of the fishing industry is compliant with the rules that govern its commercial activities.

They aim to encourage compliance with fisheries legislation through education, advice and guidance to the industry wherever possible. Where necessary they may take enforcement action which could result in a court appearance, potential fines for masters and owners, and forfeiture of equipment imposed by the court.
